CNPA 25th Governmental Affairs Fly-In – Sacramento, CA

California News Publishers Association (CNPA)

February 7, 2024

News/Media Alliance Senior Vice President, Global Government Affairs Neil Quinter will participate in the 25th CNPA Governmental Affairs Fly-In, which will convene California-based news media for an afternoon of meetings with legislators at the State Capitol.

In their meetings, they will discuss the California Journalism Preservation Act (CJPA), which would require Big Tech platforms such as Meta and Google to provide fair compensation to news publishers for use of their content online, among other topics.

Background: The News/Media Alliance is supportive of the CJPA (AB 886), which was introduced by Assemblymember Buffy Wicks (D-Oakland) in March 2023 and passed out of the California State Assembly in June 2023 in a floor vote of 55-6 before it was held over. The CA Senate Judiciary Committee held an Informational Hearing in December 2023 where California legislators learned more about the state of journalism in the state, the challenges local newsrooms face and potential solutions, and how the CJPA in particular can help support a vibrant free press. The bill is expected to be brought up early in the 2024 session.

Senate Judiciary Subcommittee on Privacy, Technology, and the Law Hearing on “Oversight of A.I.: The Future of Journalism

January 10, 2024

News/Media Alliance President & CEO Danielle Coffey testified before the Senate Judiciary Subcommittee on Privacy, Technology, and the Law held at a hearing on “Oversight of A.I.: The Future of Journalism,” which explored the impact of the growth of generative artificial intelligence (GAI) technology on publishers’ ability to provide high-quality journalism and possible oversight mechanisms to help protect and sustain quality journalism.

Coffey’s comments explained how Generative AI tools exploit news content to compete directly with publishers, yet need quality journalism to train their systems. Coffey focused on the copyright infringement implications of how GAI developers train and use their models, as well as the need for legislation, including requiring transparency and responsibility from GAI developers, and passing the Journalism Competition & Preservation Act (JCPA), which would allow publishers to collectively negotiate for fair compensation for use of their content by the dominant tech platforms, such as Meta and Google.

AI Insight Forum: “AI – Transparency, Explainability, Intellectual Property, & Copyright”

November 29, 2023

News/Media Alliance President & CEO Danielle Coffey attended as an invited participant in a bipartisan forum hosted by Senate Majority Leader Chuck Schumer on “AI – Transparency, Explainability, Intellectual Property, & Copyright.” This is the seventh AI Insight Forum that seeks to further innovation and develop bipartisan artificial intelligence legislation that takes the opportunities as well as the threats of AI technology into account. Also participating in the forum are 19 leaders from various industries, including the news media, entertainment, and tech industries.

The Forum focused on two key areas of AI policy: 1) transparency and explainability and 2) intellectual property and copyright, including addressing concerns around the use of copyrighted content in training and prompting. These are the most vital artificial intelligence concerns for the News/Media Alliance’s members.

In addition to a written statement provided in advance of the Forum, Coffey provided oral remarks sharing the unique perspective of the news and magazine industry.

The coronavirus “infodemic”, the proliferation of disinformation, and the rise of authoritarianism worldwide have underscored the importance of fact-based journalism to public health, development, and accountable governance even as it has laid bare the complicated relationship between journalism and the technology platforms that mediate the public sphere. It has also underscored the deep structural inequalities in the information ecosystem as journalism struggles to remain visible and viable amid constantly shifting changes in how news is produced, packaged, and consumed. While online platforms have offered new opportunities to connect journalists with audiences, evade censorship, and engage in influential cross-border collaborations, they have also forced journalists to contend with shifting algorithmic priorities, warped incentive structures in the online economy, and an increasingly complex array of technology policies that shape the environment in which they work.

In September 2021, more than 20 international and regional press associations in the Americas published a document claiming that the “sustainability of journalism is at risk.” The group highlighted the vulnerabilities facing the journalism industry in the digital age, where other actors capitalize on much of the value generated by news organizations. The Secretary-General of the United Nations, António Guterres, characterized the threats facing the journalism industry as a “worrying extinction of the media,” a concern that UNESCO included in their declaration Windhoek + 30.

The European Union and Australia have established initiatives in which large digital platforms compensate media outlets for the use of their content, thus achieving some progress toward sustainability of the local media. At this online event, panelists, i

ncluding News Media Alliance Executive Vice President & General Counsel Danielle Coffey, will look at a regulatory framework in the Americas that considers each nation’s different economic, cultural, and political contexts and achieves a balance between small media organizations and large technology platforms that guarantee the media’s sustainability.

Copyright protections are intended to ensure a return on investment in creative works. It is important for the government and the courts to clarify and strongly enforce those protections with regard to quality journalism that requires investment in reporters and newsrooms. However, with monopolies that distribute news content, a copyright protection is only as valuable as the ability to assert the right. In this case, competition law addresses such marketplace failure.

Solutions for America’s Local News Crisis: Policy and Peril

The Lincoln Network Reboot Conference
